These Terms of Service ("Terms") govern your use of Krownik (the "app" or "service"), a free-to-play social football game for groups of friends, operated by Alex Cortés (the "operator", "we", "us"). Krownik is played for entertainment only: it involves no betting, no wagering and no money stakes of any kind (see section 4). We may occasionally run a free promotional contest in which a physical gift is given to the players who show the most skill; entering is always free and no purchase can improve your chances (see section 4a). By creating an account or using the app, you agree to these Terms. If you do not agree, please do not use the service.
1. Eligibility and ageYou must be at least 14 years old to use Krownik. If you are under 18, you may use the service and make purchases only with the consent of a parent or guardian, who accepts these Terms on your behalf. You confirm that the information you provide is accurate.
2. Your accountYou sign in with your email address using a one-time "magic link"; there is no password. You are responsible for keeping access to your email account and for all activity under your account. You may hold only one account and must not share it or use another person's account.
3. The game and virtual itemsKrownik is a game played purely for entertainment. You join or create a private league with friends, take part in your league's game each matchweek, earn points for your play, and compare your results with the other members on a leaderboard. What you are competing for is your position on that leaderboard — nothing more.•The app uses virtual items — coins (also called tokens), boosts, power-ups and entitlements — which are NOT money and have NO monetary value.
•Virtual items are a limited, personal, non-transferable, revocable licence to use them within the game. They cannot be sold, traded, transferred to another user, cashed out, withdrawn, or exchanged for money or for anything of monetary value, inside or outside the app.
•Virtual items are never awarded as, and can never be converted into, a prize, winnings or payout.
•We may change, adjust, suspend or remove virtual items and game features at any time to operate and improve the game.
4. No gambling and no wageringKrownik is not a gambling, betting or gaming service, and it must not be used as one. Specifically:•You never place a bet and never stake money, virtual items, or anything else of value, on any outcome. Taking part costs nothing: there are no entry fees, no buy-ins and no stakes of any kind.
•There are no cash prizes, no payouts, no prize pools and no winnings. Outside a promotional contest under section 4a, the only consequence of your play is your points total and your position on your league's leaderboard.
•Nothing in the app can be won from or lost to another user. Virtual items cannot be transferred between users, and no user pays another user anything.
•We are not a bookmaker, sportsbook, betting exchange, casino or gambling operator, we are not affiliated with any such operator, and the app contains no links or referrals to one.
•The app does not provide betting tips, odds, price comparisons, or any information intended for use with a real-money gambling, betting or skill-gaming service. Any statistics, points, standings or reward probabilities shown in the app describe the game itself and nothing outside it.
•You must not use Krownik in connection with real-money betting or gambling of any kind — including organising, arranging, facilitating or settling wagers, sweepstakes, pools or side-bets between users, whether inside or outside the app. Doing so is a serious breach of these Terms and we may terminate your account for it.
4a. Free promotional contestsFrom time to time we run a free promotional contest — for example, sending a football shirt to the players who correctly predict the most exact scores over a given period. These contests do not change anything in section 4: they are contests of skill, not games of chance, and they are never a bet.•Entry is free and automatic for eligible players. There is no entry fee, no stake and nothing to buy. No purchase is necessary to enter or to win.
•No purchase improves your chances. Winners are ranked by a measure of skill that a purchase cannot increase — for the exact-scores contest, the number of distinct matches you predicted exactly, so buying additional league slots does not earn you extra entries.
•The winner is determined by skill (the accuracy of your predictions), not by lot, chance or a random draw.
•Prizes are physical gifts. They are never cash, never a payout, never virtual items or tokens, and they cannot be exchanged for cash or for anything else in the app.
•You lose nothing by taking part or by not winning: your points, virtual items and standing are unaffected either way.
•Each contest has its own published rules — covering the exact period, who may enter, how the winner is decided, how ties are broken and where we can ship — and those rules apply in addition to these Terms. You can read the rules of the current contest in the app.
•Apple and Google are not sponsors of, and are in no way involved in, any promotional contest we run.
5. PurchasesYou may buy virtual items through in-app purchases processed by the Apple App Store or Google Play. Those purchases are also subject to the applicable store's terms. Prices are shown before purchase and include applicable taxes where required. We do not process or store your payment-card details.
6. Refunds and right of withdrawalVirtual items are digital content supplied immediately. As an EU consumer you normally have a 14-day right of withdrawal for digital content; however, by purchasing and immediately accessing or using virtual items, you expressly request immediate performance and acknowledge that you lose the right of withdrawal once delivery has begun, in accordance with Spanish consumer law.Refund requests for in-app purchases are handled by the Apple App Store or Google Play under their policies. Nothing in these Terms limits your mandatory statutory consumer rights.
7. Fair play and prohibited conductTo keep the game fair for everyone, you must not:•cheat, use bots, scripts, automation or exploits, or manipulate answers, scores or leaderboards;
•create multiple accounts, or collude to gain an unfair advantage;
•reverse-engineer, decompile, tamper with, or attempt to bypass the security of the app or its servers;
•access the service through unofficial clients or interfere with its normal operation;
•use the service for real-money betting or gambling, or to organise, facilitate or settle wagers, pools or side-bets of money or anything of value between users;
•offer, advertise or attempt to sell, buy or transfer virtual items, accounts or in-game positions for money or anything of value;
•upload unlawful, offensive, infringing or harmful content, or harass other users.
8. User contentYou are responsible for the content you provide, such as your display name and league names. You must not use content that is offensive, misleading, infringing or unlawful. You grant us a licence to use that content solely to operate and display the service.
9. AdvertisingThe service is supported by advertising, including optional rewarded ads you may choose to watch in exchange for in-game rewards. Ads are provided by third parties as described in our Privacy Policy.
10. Intellectual propertyThe app, its design, code, trademarks and content are owned by the operator or its licensors. We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the app for your own entertainment. All rights not expressly granted are reserved.
11. Third-party servicesThe service relies on third parties, including football-fixture data providers, the app stores, and Google services for notifications and advertising. We are not responsible for third-party services, and their terms and policies also apply to your use of them.
12. Availability and changes to the serviceWe work to keep the service available but do not guarantee it will always be uninterrupted or error-free. We may modify, suspend or discontinue all or part of the service, including features and virtual items, at any time.
13. DisclaimersThe service is provided "as is" and "as available". Everything shown in the app — questions, results, points, standings and statistics — is provided for entertainment only, is not guaranteed to be accurate or complete, and must not be relied on for any betting, gambling or financial decision. To the extent permitted by law, we disclaim implied warranties; this does not affect your mandatory statutory consumer rights.
14. Limitation of liabilityTo the fullest extent permitted by law, we are not liable for indirect or consequential loss, or for loss of virtual items resulting from your breach of these Terms or from changes to the game. Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or your statutory consumer rights.
15. Suspension and terminationYou may stop using the service and close your account at any time. We may suspend or terminate your account if you breach these Terms or misuse the service. On termination, your licence to use the app and any virtual items ends, and virtual items are forfeited without a refund, except for refunds required by law.
16. Changes to these TermsWe may update these Terms from time to time. We will post the updated version here and change the "Last updated" date; significant changes will be notified in the app. Continued use after changes take effect means you accept the updated Terms.
17. Governing law and disputesThese Terms are governed by Spanish law. If you are a consumer, you may bring proceedings in the courts of your place of residence, and mandatory consumer-protection rules of your country of residence continue to apply. EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
